This Personal Data Protection Policy (hereinafter the "Policy") is that of Yan Haltey Brands Sàrl, a Swiss company with its registered office at Rue Saint-Martin 32, 1005 Lausanne, Switzerland, registered with the Commercial Registry under Company ID No. CH-550-1195939-0 (hereinafter "YHB" or "We").
This Policy is intended to inform you of how YHB processes your personal data (hereinafter "Personal Data") and of the rights you have in this regard. It applies as soon as you access this website.
All communications should be addressed to our customer service team (hereinafter "Customer Service"), reachable via the contact form or by email at contact@yanhaltey.com.
Article 1 · Legal framework
The processing of your personal data is governed by the Federal Act on Data Protection (FADP, SR 235.1) and the Data Protection Ordinance (DPO, SR 235.11).
To the extent that YHB uses third-party services whose servers are located in the European Union, or that process data of EU residents, the relevant requirements of the General Data Protection Regulation (GDPR, EU Regulation 2016/679) are taken into account in the choice and configuration of these services.
In accordance with Art. 19 FADP, this Policy constitutes the information provided to data subjects at the time their personal data is collected.
Article 2 · Data collected on the website
When you visit our website, we automatically collect certain information about your device, including information about your web browser, IP address, operating system, time zone, and some of the cookies installed on your device.
As you browse the site, we also collect information about the pages viewed, the third-party sites or search terms that referred you to our site, and how you interact with the site.
If you use our forms (contact, appointment booking, online assessment, newsletter sign-up), we collect the information you voluntarily provide: last name, first name, email address, phone number, questionnaire answers, message. The phone number is used exclusively to contact you back regarding your request.
Article 3 · Sensitive data
YHB does not intentionally collect sensitive data within the meaning of the FADP (data concerning health, political opinions, religious beliefs, ethnic origin, genetic or biometric data).
If you voluntarily disclose information of this nature in your communications with us, YHB does not process it in any specific manner and applies the same protective measures to it as to the rest of your data.
Article 4 · Data not collected
YHB does not directly collect full banking data (card number, CVV), which is processed exclusively by our payment providers. YHB also does not collect precise geolocation data.
Article 5 · Purposes of processing
We only process data necessary for the purposes for which it was collected:
- Service delivery: management of consulting, creative and support services.
- Service-related communication: follow-up on requests, appointment reminders, information about our services.
- Payment and billing: processing payments, issuing invoices.
- Service improvement: anonymized, aggregated analysis of website usage.
- Advertising performance measurement: measuring the effectiveness of our online advertising campaigns.
- Marketing communication: sending newsletters, offers, editorial content, only with your consent.
- Security: detecting and preventing unauthorized access, fraud and security incidents.
- Legal obligations: retaining accounting records, responding to requests from competent authorities.
YHB does not sell or rent your personal data. Data shared with third-party providers for advertising measurement purposes is limited to what is strictly necessary.
Article 6 · Legal bases
Processing necessary for service delivery, service-related communication, payment and billing is based on the performance of the contract between us.
Processing related to service improvement, advertising performance measurement and security is based on YHB's overriding interest. You may object to it via the cookie management banner, or on legitimate grounds relating to your particular situation.
Processing related to marketing communication is based on your consent. You may withdraw it at any time.
Processing related to accounting and legal obligations is based on the legal obligations imposed on YHB.
Article 7 · Data sharing
We only share your personal data with the categories of recipients described below, strictly to the extent necessary for the purposes mentioned in Article 5.
Article 8 · Delivery partners
When you activate a delivery service, the data strictly necessary to carry out the service (specification elements, brief, content you have approved) may be shared with the relevant partner. This sharing is limited to the scope of the service you approved. Partners are bound by the confidentiality obligations set out in the general terms of the service agreements.
Article 9 · Hosting and data location
Your personal data is hosted in Switzerland. Certain technical subcontractors may process data abroad, notably for sending emails and SMS, audience analysis and advertising performance measurement. Such processing may in particular take place in the European Union, Singapore or the United States.
Article 10 · Technical subcontractors
YHB uses technical service providers for the operation of the website. These providers process personal data on YHB's behalf.
The categories of subcontractors we use are as follows: hosting, payment, email, SMS, audience analysis, advertising measurement and search engine optimization.
We select our subcontractors taking into account their data protection and security commitments.
Article 11 · Authorities
We may be required to disclose personal data to the competent authorities where required by law (legal obligation, court order, criminal investigation).
Article 12 · No other recipients
Other than in the cases described in Articles 8 to 11, we do not disclose your personal data to third parties.
Article 13 · Retention periods
We retain your personal data only for as long as necessary for the purposes for which it was collected, or for as long as required by law.
Browsing and form data is retained for as long as necessary for the purposes for which it was collected.
Billing and accounting data is retained for the period required by applicable legal obligations.
Article 14 · Rights guaranteed under the FADP
Under the FADP, you have the following rights:
- Right of access (Art. 25 FADP): obtain a copy of your data and information about its processing.
- Right to rectification (Art. 32 para. 1 FADP): request correction of inaccurate or incomplete data.
- Right to erasure (Art. 32 para. 2 let. c FADP): request deletion of your data, subject to legal retention obligations.
- Right to data portability (Art. 28 FADP): receive your data in a structured, commonly used format.
- Right to object: object to processing based on YHB's overriding interest.
- Right to withdraw consent: withdraw any consent given, at any time.
Article 15 · Exercising your rights
To exercise your rights, send your request in writing to Customer Service. We may ask for proof of identity to verify your identity.
We respond within 30 days. This period may be extended by a further 30 days for complex requests, with notice.
Exercising your rights is free of charge. We may decline to act on requests that are manifestly unfounded or excessive.
Article 16 · Right to lodge a complaint
If you believe that the processing of your personal data does not comply with applicable law, you may contact the competent data protection authority.
Article 17 · Security measures
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, use, modification or disclosure.
Access to data is limited to individuals with a legitimate need in connection with their duties. All our staff and subcontractors are bound by confidentiality obligations.
However, no transmission of data over the Internet or a wireless network can be guaranteed.
Article 18 · Types of cookies
Cookies are small text files placed on your device when you browse the website.
Strictly necessary cookies are essential for the website to function (security, session). They cannot be disabled.
Analytics cookies let us measure traffic and analyze user behavior to improve the service. You can disable them via the cookie management banner or your browser settings.
Advertising measurement cookies let us measure the effectiveness of our online advertising campaigns. You can disable them via the cookie management banner.
Third-party cookies may be set by certain embedded services (video player, podcast player). We do not control these cookies and invite you to review the privacy policies of the services concerned.
Article 19 · Managing cookies
You can set your preferences via the cookie management banner, configure your browser to refuse some or all cookies, or delete cookies already placed. Refusing strictly necessary cookies may prevent access to certain features.
Article 20 · Minors
YHB's services are intended for an adult audience (18 years or older). We do not knowingly collect personal data from minors.
Article 21 · Changes to this Policy
We may amend this Policy at any time. Amendments take effect as soon as they are published on the website. The version date is indicated at the top of the document.
Article 22 · Governing law and jurisdiction
This Policy is governed exclusively by Swiss law. Any subsequent dispute concerning the interpretation of this Policy shall be submitted to the ordinary courts of Lausanne.
